The Newbern Shop Rental Agreement

Event Reservation

This Rental Agreement (“Agreement”) outlines the terms and conditions for renting yard games from The Newbern Shop. A signed rental agreement and a non-refundable deposit of fifty percent (50%) of the total rental price are required to reserve a date for an event. If the rental is canceled for a reason not addressed in this rental agreement, the renter will forfeit the deposit.

The standard rental period is 72 hours. Adjustments to the rental period can be made upon request and must be agreed upon by both parties. The renter is responsible for safely storing the games from inclement weather and preventing damage from the time of delivery until pickup.

The games will be delivered a minimum one (1) hour prior to the scheduled start of the event.
Games will be picked up at the scheduled end of the event.
Delivery and pick-up times can be adjusted upon request and must be agreed upon by both parties.

A security deposit of (50%) of the total rental price will be collected from the renter.
The deposit will be held until the games are picked up and confirmed to be in the same condition as when delivered.
The deposit will be used to repair any damage beyond normal wear and tear.
It will be returned by check after a final inspection when the games are picked up.
If the renter is unavailable at the end of the event, the check will be mailed within ten (10) days after the event’s conclusion.

The final payment, equal to the outstanding balance, is due one (1) week from the event date.
Games will not be delivered or set up if final payment is not received before the event starts.

In case of inclement weather during the rental period, the renter must move the games to a dry location to prevent water damage.
If inclement weather occurs before the event and the venue lacks an indoor contingency plan, a full refund of the rental price will be provided.

Every effort will be made to rebuild a lawn game if it is stolen or completely destroyed by the previous renter.
If a game is unavailable due to damage or theft:
An available alternate game will be offered with the rental price adjusted accordingly.

If a game is deemed unsuitable for the venue (due to potential damage), an alternate game will be offered with the rental price adjusted accordingly.
